Comment by the Information and Press Department on Ukraine filing an arbitration memorandum regarding the Kerch Strait incident
On May 22, Ukraine filed an arbitration memorandum substantiating earlier demands under an interstate inquiry, initiated against the Russian Federation in April 2019 on the basis of the 1982 UN Convention on the Law of the Sea in connection with the November 2018 Kerch Strat incident.
As is known, this incident was a deliberate provocation on the part of Ukraine involving a violation of Russian legislation when three Ukrainian warships sailed via the territorial sea of the Russian Federation and attempted to break through into the Kerch Strait. The ships and their crew members were detained as a result.
As compared to an earlier claim, filed by Ukraine, the memorandum contains no entirely new elements. At the same time, Kiev is forced to heed the transfer of sailors and ships to Ukraine in the autumn of 2019, and this has considerably reduced the list of its initial claims.
Next, Russia will have to file its jurisdictional objections regarding this case by August 22, 2020 under the relevant rules of procedure.
