Press release on the arbitral tribunal on the law of the sea (claim of Ukraine against the Russian Federation)
On 12 May the arbitral tribunal established under the UN Convention on the Law of the Sea on the request of Ukraine claiming violation by the Russian Federation of this Convention held its first meeting.
The arbitral tribunal presided by Judge Jin-Hyun Paik (Republic of Korea) considered, with the participation of representatives of the Russian Federation and Ukraine, the principal procedural documents that will govern the work of the tribunal.
On 18 May the tribunal adopted its Rules of Procedure that will apply to consideration of the “Dispute Concerning Coastal State Rights in the Black Sea, Sea of Azov, and Kerch Strait”. They provide that by 19 February 2018 Ukraine has to submit to the tribunal its memorial containing its detailed claims, following which Russia will have to present its reply by 19 November 2018. Additionally, the Russian Federation has the right to make objections to the jurisdiction of the tribunal, which may be considered at a preliminary stage. This may be done within three months after the submission of the memorial by Ukraine.
